On December 16, 2016, T.J. Miller and his wife used an Uber car service to get a ride home after making appearances at two Hollywood parties. Miller, during this Uber car ride, allegedly was involved in a physical altercation with the Uber driver, Wilson Deon Thomas III. Apparently, Miller struck the driver in the head and the shoulder, forcing him to slam on the breaks, resulting in injury and anxiety. Wilson Deon Thomas III sued Miller for assault and battery and intentional infliction of emotional distress. After being sued, Miller’s lawyer filed a reply to Thomas’ complaint at the Superior Court in Los Angeles on March 13, 2017 in which he denied all the claims and accused Thomas of attempting to extort his client.
Miller’s lawyer argues that this isn’t the first time Thomas has created fictitious stories in order to sue and make money. He further states that Thomas sued his former employer for wrongful termination after seeking work restrictions for an ankle injury. “From the moment Miller and his wife stepped into Thomas’ vehicle and he recognized Miller as a comedian and Hollywood actor, Thomas started a plan to try and extort money from Miller, even commenting that Miller was ‘a rich guy’, writes Miller’s attorney in a reply to the complaint.
Miller’s Attorney further stated that Thomas’ doctor stated that he received minor aches and slight pain from the alleged incident. Miller is seeking to completely dismiss the suit and to be awarded costs and attorney fees.
